BIS Exemption for Steel Importers

We ERCS Pvt Ltd. help importers and provide technical support for obtaining the NOC/Exemption on some steel and steel products from Ministry of steel. As per the BIS guideline, the steel products which are mandatory to get BIS/ISI certification. As we know, ISI Mark is the quality mark which ensure that the product is best in quality. However, In the steel there are so many grades according to the type of steel, Dimension, Chemical properties, Mechanical composition and finishing of material which must be complying with the relevant Indian Standard (IS) to get the BIS/ISI Certificate but If the steel product is identical (In the mandatory list of BIS) and their actual properties do not comply with the properties given in the relevant Indian Standard, then NOC or Exemption is required instead of BIS certificate for consignment clearance in custom.

To avoid delays and Penalties in Customs, you just need to get a NOC or Exemption on steel from the Ministry of Steel. ERCS provide technical consultation to get the NOC without unnecessary delays.   

How we can apply for NOC/Exemption –

Firstly, applicant/Importer have to ensure that whether their product is in the quality control order of the Ministry of Steel or not. If it is in the list but properties different then NOC is required to the custom clearance.

Which documents are required to obtain the NOC-?

  1. Product Specification and application
  2. Mill test Certificates (MTC)
  3. Declarations
  4. Material information in Excel sheet
  5. Bill of lading
  6. Invoice
  7. IEC Code
  8. PAN no.

Applicant have to register on online portal given by the Ministry of steel and submit the above documents and other requested information.

● It means that the application has been selected for onward evaluation by the Technical Committee.

APPROVED

● It is merely a status which means, that the application was found in order by the Technical Committee and a decision has been taken in this regard.

 

● Applicant may refer to the email which was sent regarding Decision of Technical Committee. The rows below will help to understand the terminologies used in the Technical Committee’s decision.

Out of Purview

● It means that the consignment containing the applicant's steel grade/product has been evaluated by the Technical Committee and it currently does not fall under the purview of the Steel and Steel Products (Quality Control) Order, 2020.

 

● In this regard a system generated clarification letter is sent to the applicant for clearance of said consignment only.

Covered

● It means that the applicant's steel grade/product has been evaluated by the Technical Committee and it falls under the purview of the Steel and Steel Products (Quality Control) Order, 2020.

 

● Any imported consignment of such steel grade/product shall bear the Standard Mark under a license from the BIS as per Scheme–I of Schedule–II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.

 

● No clarification letter shall be issued for clearance of such consignments containing such kind of steel grades/products.

Rejected/Deferred

● It means that the Technical Committee has found some shortfall in the application and hence is unable to evaluate it.

 

● The applicant is informed about the same via email. The applicant is advised to address the communicated reason/s for rejection properly and re-apply for evaluation in the subsequent meetings.

Overlapping

● This decision is specific to the “Clarification in Advance” application category only, i.e., before the import of the actual consignment.

 

● It means that the applicant's steel grade/product has been evaluated by the Technical Committee and either the chemical composition or the mechanical properties or both overlap with any of the Indian Standard which is notified under Steel & Steel Products (Quality Control) Order, 2020.

 

● Such grades cannot be decided as Out of Purview or Covered based on sample MTC and consignment specific decisions (whether covered under the SQCO or not) could only be taken on the perusal of actual MTC.

Out of Scope of Technical Committee

● It means that the steel grade/product in the application is out of the mandate of Technical Committee/MoS. However, it may be falling under the purview/mandate of any other QCO issued by any other Department/Ministry of GoI.
