The Indian Government directs through BIS the mandatory use of Standard Mark under a License or Certificate of Conformity (CoC) by issuing Quality Control Orders (QCOs). The government has made it mandatory for a number of reasons, including the public interest, the protection of the health of people, animals, environment's safety, the avoidance of unfair trade practices, and national security.
Recently, the Ministry of Chemical and Fertilizers, Department of Chemicals and Petrochemicals has introduced a quality order called the Ortho Phosphoric Acid (Quality Control) Second Amendment Order, 2024. Following the date of publication in the Official Gazette, this regulation will come into force.
In the Ortho Phosphoric Acid (Quality Control) Order, 2021, the following proviso is inserted :
“Provided that, nothing in this Order shall apply to the Ortho Phosphoric Acid when used as raw material in production of fertilizers.”
The Bureau of Indian Standards has been designated as the certifying and enforcing authority for Ortho Phosphoric Acid. Any violation of this order will incur penalties as per the provisions outlined in the Bureau of Indian Standards Act, 2016.
1. Effective Date:
On July 26, 2024, the Ortho Phosphoric Acid (Quality Control) Order, 2021 second Amendment Order, 2024, shall take effect.
2. Applicability:
This Order covers products containing orthophosphoric acid; products intended for export are not covered.
3. Standards Compliance:
Goods or articles of Ortho Phosphoric Acid must conform to Indian Standard IS 798:2020. Although you can also register to get BIS for Ortho Phosphoric Acid and bear the Standard Mark under a license from the Bureau of Indian Standards as per Scheme-II of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
4. Certification and Enforcement:
The Bureau of Indian Standards (BIS) shall be the certifying and enforcing authority for Ortho Phosphoric Acid goods or articles.
